What is a Procedural Fairness Letter?

Procedural fairness requires that individuals are given a fair and unbiased assessment of their application.  It also required that the individual be informed of the decision-maker’s concerns so that the person may have a meaningful opportunity to respond to any concerns identified in their application. Procedural fairness applies to all immigration and citizenship applications alike and to all aspects of the decision-making process.

A Procedural Fairness Letter is correspondence issued by the immigration officer to the individual and specifically states any concerns the officer may have with the submitted application.  It can take a month for your lawyer to prepare the appropriate response required by the immigration office. In some circumstances an extension to submit, may be required depending on the nature of your case.
