A person who is inadmissible to Canada due to security or health reasons, can still come to Canada by applying for a temporary resident permit (TRP). It can be helpful for family members to unite with their families temporarily. It can help people with medical inadmissibility to come to Canada for humanitarian, social and work reasons like professional athletes, artists and emergency workers. 

What is a TRP?

TRP is a document that helps a person to overcome his inadmissibility and come to Canada for a specific reason. The applicant must be able to justify their reason to enter Canada. The officer would then consider the reason and make sure that the person is not a security or health threat to Canada, and then issue a TRP for a specific time period.

Why is a TRP needed?

When following the IRPA, the people inadmissible to Canada cannot get a visa. But in certain cases there may be compelling reasons where a person should be given entry, even though they are inadmissible. The TRP helps the officers to consider the reasons and issue the person a permit. 

When can a TRP be granted?

The officer would consider the following when assessing a situation:

  • The reasons for issuing the TRP such as ties with family members in Canada, work related tasks, significant contribution to the economy, attending an event, etc.
  • They would also see how the decision to issue the TRP would affect the health and safety of Canadians.

How long can a TRP be issued for?

A TRP is usually issued only for a certain period of time. For example, it can be valid for two weeks, in order to attend a trade fair. The maximum validity for which a TRP can be issued is three years. But officers do not usually issue for such a long time.

How can I apply for a TRP?

  •       You can apply for a TRP at the consulate where you live.
  •       U.S. citizens and permanent residents can apply at the port of entry.

Is an interview needed for a TRP?

An interview may be needed before issuing a TRP depending on the reason for inadmissibility. If serious criminal charges are involved then an interview is conducted to determine if the person may be a threat to Canada. If it is on the basis of medical inadmissibility or on the basis of minor criminal charges, then an interview may not be necessary. 

How long does it take to process a TRP application?

It usually takes 3 to 6 months to process a TRP application applied at a Consulate. When applied at a port of entry, it usually takes a few minutes or longer.

Can I use a TRP to re-enter Canada?

A TRP is no longer valid if you leave Canada. If a person needs to re-enter and exit in the future, the TRP holder should have permission to do so.

How can I overcome criminal inadmissibility?

You can overcome criminal inadmissibility permanently by:

  •       You can submit an application for Criminal Rehabilitation.
  •       You can overcome it by virtue of Deemed Rehabilitation.

 

Fees: $200, Serious Criminality $ 1,000.
